1. Introduction

Welcome to Magna Movimento SRL. These Terms & Conditions govern the use of our website, rental services, equipment leasing arrangements, and related services provided by our company.

By accessing our website, requesting equipment rental services, or entering into a rental agreement with us, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

Our company provides professional equipment rental solutions, including construction equipment, mining machinery, earthmoving equipment, agricultural equipment, generators, and support vehicles.

2. Definitions

For the purpose of these Terms & Conditions:

"Company," "we," "us," or "our" refers to Magna Movimento SRL.

"Customer," "client," "you," or "your" refers to any individual, business, organization, or entity requesting or using our rental services.

"Equipment" refers to all machinery, vehicles, tools, accessories, and related items supplied by the Company.

"Rental Agreement" refers to the contractual agreement between the Company and Customer governing equipment rental.

3. Equipment Rental Services

We provide equipment rental services for construction, mining, agricultural, industrial, and related applications.

Equipment availability is subject to fleet status, maintenance schedules, prior bookings, and operational requirements. Magna Movimento SRL reserves the right to provide substitute equipment of equal or comparable capability when necessary.

All rental requests are subject to approval and confirmation by the Company.

4. Rental Booking and Confirmation

A rental booking becomes valid only after:

  • Customer requirements have been reviewed and approved

  • Equipment availability has been confirmed

  • Rental terms and pricing have been accepted

  • Required documentation has been submitted

  • Any applicable deposit or payment requirements have been completed

Verbal discussions, inquiries, or quotations do not constitute a confirmed rental agreement unless formally approved by Magna Movimento SRL.

5. Customer Responsibilities

The Customer agrees to:

  • Use the equipment only for its intended purpose

  • Operate equipment according to manufacturer guidelines and safety procedures

  • Ensure that operators are properly trained, licensed, and authorized where required

  • Maintain safe working conditions at the operating location

  • Prevent unauthorized use, transfer, or modification of equipment

  • Immediately report damage, malfunction, theft, or safety concerns

The Customer is responsible for ensuring compliance with all applicable workplace safety, environmental, and operational regulations.

6. Equipment Condition and Inspection

All equipment is supplied in operational condition and undergoes inspection and maintenance procedures before rental.

The Customer should inspect equipment upon delivery and notify Magna Movimento SRL immediately of any concerns or defects.

Failure to report issues may be considered acceptance of the equipment condition.

7. Equipment Use and Restrictions

The Customer shall not:

  • Use equipment for illegal activities

  • Operate equipment beyond manufacturer specifications

  • Modify, repair, or alter equipment without written approval

  • Remove identification labels or safety markings

  • Allow unauthorized persons to operate the equipment

Any misuse, negligence, or unauthorized operation may result in additional charges and liability.

8. Rental Period

The rental period begins when equipment is delivered or made available to the Customer and continues until equipment is returned or collected by Magna Movimento SRL.

The Customer must return equipment on the agreed date and in acceptable condition.

Extensions must be requested and approved before the rental period expires.

9. Payments and Charges

Rental fees, deposits, transportation costs, additional services, and applicable taxes will be communicated before confirmation.

The Customer agrees to pay all invoices according to the agreed payment terms.

Late payments may result in:

  • Additional charges

  • Suspension of rental services

  • Recovery action for outstanding amounts

10. Delivery and Collection

Magna Movimento SRL may provide delivery and collection services subject to availability and agreed charges.

The Customer is responsible for ensuring:

  • Site access is safe and suitable

  • Delivery areas are prepared

  • Necessary permits or permissions are obtained where required

Delays caused by unsafe site conditions or customer-related issues may result in additional charges.

11. Maintenance and Repairs

The Company is responsible for routine maintenance required due to normal operation.

The Customer must immediately notify Magna Movimento SRL of any breakdown, damage, or unusual equipment performance.

Repairs resulting from misuse, negligence, unauthorized operation, accidents, or failure to follow operating instructions may be charged to the Customer.

12. Damage, Loss, and Theft

The Customer is responsible for protecting rented equipment during the rental period.

The Customer may be liable for:

  • Loss of equipment

  • Theft

  • Damage caused by negligence

  • Unauthorized use

  • Failure to follow safety procedures

The Company reserves the right to recover repair, replacement, transportation, and related costs.

13. Insurance Requirements

The Customer may be required to maintain appropriate insurance coverage for rented equipment, operators, and project activities.

Insurance requirements will depend on equipment type, project conditions, and applicable regulations.

The Customer remains responsible for compliance with all required insurance obligations.

14. Cancellation Policy

Cancellation terms may vary depending on equipment type, rental duration, preparation costs, and booking notice.

Magna Movimento SRL reserves the right to apply cancellation fees where applicable.

15. Limitation of Liability

To the maximum extent permitted by law, Magna Movimento SRL shall not be responsible for indirect losses, delays, loss of profits, or business interruption resulting from equipment rental, availability issues, or circumstances beyond reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded.

16. Force Majeure

Magno Movimento SRL shall not be liable for delays or failure to perform obligations caused by events beyond reasonable control, including:

  • Natural disasters

  • Government restrictions

  • Labor disputes

  • Transportation disruptions

  • Severe weather conditions

  • Equipment supply interruptions

17. Website Use

Website content is provided for general information purposes only.

Magno Movimento SRL makes reasonable efforts to ensure information accuracy but does not guarantee that all website content is complete, current, or error-free.

The Customer agrees not to misuse the website or attempt unauthorized access.

18. Intellectual Property
